Summary

Georges River Council and GTB Hurstville Pty Limited (the Developer) entered into a Planning Agreement (VPA) pursuant to the Environmental Planning and Assessment Act 1979 on 25 September 2020 in relation to the development of 9 Gloucester Road and 420-430 Forest Road, Hurstville.

The VPA requires the Developer to provide a monetary contribution of $3,619,308 for public facilities in the LGA and is to be paid to Council within 28 days after the Hurstville Local Environmental Plan Amendment for the site takes effect.

Background

The VPA relates to the Planning Proposal PP2015/0005 that applies to the land. The Planning Proposal seeks to amend Hurstville Local Environmental Plan 2012 by increasing the Floor Space Ratio and maximum Height of Buildings for the land.

Council received an Offer to enter into a VPA in association with the Planning Proposal on 23 April 2019.

The VPA Offer was reported to the Council Meeting on 24 June 2019. Council accepted the VPA Offer and Heads of Agreement to enter into a VPA.
 

Description of the VPA

The VPA requires the Developer to provide a monetary contribution of $3,619,308. The contribution is to be applied in Council’s discretion towards public facilities in the Council’s area, including any public infrastructure, amenities and services, public domain and public road infrastructure, and key traffic and road infrastructure in the Hurstville City Centre. The full  contribution amount of $3,619,308 is to be paid within 28 days after the date the LEP Amendment takes effect.

The above public benefits are over and above any future section 7.11, 7.12 and 7.24 contributions under the Environmental Planning and Assessment Act 1979 applicable to the development.
 

Date of public notification of the draft VPA

The draft VPA was on public notification from 22 January to 21 February 2020 in conjunction with the Planning Proposal.
