Planning Agreement

Summary

The former Hurstville City Council entered into a Planning Agreement pursuant to section 93F of the Environmental Planning and Assessment Act 1979 with GR Capital Group Pty Limited. The Planning Agreement is in connection with a Development Application (DA2014/1083) for 1-5 Treacy Street and 1 Hill Street, Hurstville.

Background

The Planning Agreement was submitted in connection with a development application (DA2014/1083) for 1-5 Treacy Street and 1 Hill Street, Hurstville for the demolition of existing structures and construction of a new eleven (11) storey mixed use development with basement parking. The Council accepted the offer to enter into the proposed Planning Agreement on the 19 November 2014. The Development Application was approved by the Sydney East Region Joint Regional Planning Panel (JRPP) with a condition of consent requiring the Planning Agreement be entered into before the issuance of any Construction Certificate for the proposed development.

Description of the Agreement

The Planning Agreement will provide the following public benefits:

  1. Dedication of 27.3m2 strip of land (1 metre wide) on the western boundary of the land (adjacent to The Avenue) for footpath and future road widening.
  2. Dedication and fitout of commercial floor space (81m2) and one (1) at grade parking space in the development.
  3. Footpath and paving upgrade, landscaping and public furniture on the site (Zone 1).
  4. Construction of footpath, kerb and gutter and landscaping adjacent to the site and The Avenue (Zone 2).
  5. Landscaping works and retaining wall on the western side of The Avenue (Zone 3).
  6. Footpath and paving upgrade, landscaping and public furniture to the north and opposite the site (Zone 4).
  7. Maintenance of the landscaping works for 12 months.

The Planning Agreement works and dedications are in addition to the section 94 contributions levied in the development consent.

Land to which this agreement applies

The Planning Agreement applies to 1-5 Treacy Street and 1 Hill Street, Hurstville (Lot 14,15 and 16 of Section A in DP2752 and Lots 1 and 2 in DP306979)

Public notification dates of Proposed Agreement

The proposed Planning Agreement and Explanatory Note was publicly notified from Thursday, 29 October 2015 until Thursday 26 November 2015.

Date the agreement was entered into

The Planning Agreement was executed on 14 March 2016 and is registered on the land.

Parties to the Agreement

GR Capital Group Pty Limited and Georges River Council.

Address of the Land

The Deed of Variation to the VPA applies to the land legally identified previously as Lots 1 and 2 in DP306979, known as 1 Hill Street, Hurstville and Lots 14,15 and 16 of Section A in DP2752, known as 1-5 Treacy Street, Hurstville now legally identified as CP/SP 91614, known as 1 Treacy Street, Hurstville.

Date the agreement was entered into

The Deed of Variation to the VPA was executed on 5 December 2023.

Summary of Deed of Variation to the Planning Agreement

The Deed of Variation amends the existing Planning Agreement that was executed on 14 March 2016.

The Deed of Variation amends the existing Planning Agreement to require the Developer to pay a contribution of $550,000 to Council in return for the release of the Developer from its obligation to dedicate the commercial space at 1-5 Treacy Street, Hurstville.

Council at its meeting on 28 August 2023 resolved to endorse the amendments and that the Deed be placed on public exhibition.

Public notification dates of Proposed Deed

The Deed of Variation was on public notification from 20 September to 20 October 2023.
