Deed of Variation for Voluntary Planning Agreement - 6 Cross Street, Hurstville

Summary

On 20 March 2018, Council and the Illawarra Catholic Club entered into a VPA in relation to the Development Consent DA2017/0040 for the construction of a 9 storey building for the extension to the Illawarra Catholic Club and tourist and visitor accommodation. The VPA requires the Developer to make a monetary contribution of $976,147 toward public infrastructure in the Hurstville City Centre, including the embellishment of Central Plaza and upgrade of the local road network.

On 27 September 2018 Council received an offer to enter into a VPA that would amend the existing VPA (referred to as a Deed of Variation). The VPA offer related to the Development Consent DA2018/018 for the conversion of the 9th floor of the approved development to a rooftop terrace.

The VPA offer was reported to the Council Meeting on the 26 November 2018 (CCL066-18). Council accepted the terms of Offer to enter into a Deed of Variation.
 

Description of the Deed of Variation to the Planning Agreement

The Deed of Variation requires the Developer to provide a monetary contribution of $142,605.19 for public infrastructure in the Hurstville City Centre and upgrade of the local road network. This contribution is in addition to the monetary contribution of $976,146.

The monetary contribution is over and above any section 7.11, section 7.12 and s7.24 contributions under the Environmental Planning and Assessment Act 1979 applicable to the development.

 
Date of Public Notification of draft Deed

The draft Deed was on public notification from 6 June to 8 July 2019.


Date the agreement was entered into

The Deed was executed on the 22 August 2019.

The Deed of Variation to the VPA applies to part of Lot 100 DP123004 (that was previously comprised of Lot 1 and Lot 2 DP508397) being No. 6 Cross Street, Hurstville.
