Starting a food business is an exciting step, but it is important to get the basics right from the start. There are specific requirements for fitting out your premises and meeting health, safety and legal standards.
Before you sign a lease, start building, renovate, or take over an existing business, take the time to review the information below. It will help you understand the process, avoid costly mistakes, and make sure your business is set up properly.
Setting Up a New Food Business
If you want to open a food business in a place that is empty, used for something else, or has never sold food, you must get approval first.
You may also need planning approval if you plan to do major renovations. This could mean lodging a Development Application with Council before any work begins.

Buying and Trading in an Existing Food Business
If you’re buying or taking over an existing food business that is already trading, you may only need to notify Council before you start operating, as long as:

No changes are being made to the premises, or

Only minor work is planned, such as replacing equipment or repairing damaged fixtures and fittings.
Before you buy the business or sign a lease, make sure to check:

That the premises is approved to operate as a food business.

The approved trading hours.

Any conditions that could affect how you use the premises.

If you plan to make major changes, such as full renovations, adding a cool room, or installing a mechanical exhaust system, you must get Council approval before starting any works. Making changes without approval can lead to fines and you may be required to remove or undo the unapproved works.
