VOLUNTARY PLANNING AGREEMENT FOR PART OF THE LANDMARK SQUARE PRECINCT

Summary

Georges River Council and Prime Hurstville Pty Limited (the Developer) entered into a Planning Agreement (VPA) pursuant to the Environmental Planning and Assessment Act 1979 on 26 August 2019 in relation to part of the Landmark Square Precinct at 61-69, 71A, 73 and 75 Forest Road, 126 Durham Hurstville.

The VPA requires the Developer to provide a monetary contribution of $7,375,878, the dedication of land and carrying out of works to widen a section of Roberts Lane, and the provision of public access easements.

Background

The VPA relates to the Planning Proposal PP2015/0001 that applies to the whole of the Landmark Square Precinct. The Planning Proposal seeks to amend Hurstville Local Environmental Plan 2012 by rezoning the land from IN2 Light Industrial and part R2 Low Density Residential to B4 Mixed Use; to amend the Floor Space Ratio, Height of Buildings and Active Street Frontage maps; and apply a bonus floor space ratio incentive for the purpose of hotel accommodation.

Council received an Offer to enter into a VPA in association with the Planning Proposal on 11 July 2017.

The VPA Offer was reported to the Council Meeting on 7 August 2017 (CCL146-17). Council accepted the VPA Offer and Heads of Agreement to enter into a VPA.

Description of the VPA

The VPA requires the Developer to provide the following public benefits:

  • a monetary contribution of $7,375,878 for public facilities, public domain works and public road infrastructure including upgrades and embellishments to Kempt Field and public domain works in the Hurstville City Centre;
  • dedication of land to Council to widen a section of Roberts Lane;
  • carry out the works to widen the section of Roberts Lane; and
  • provide public access easements to, from and across the land.

The above public benefits are over and above any future section 7.11, 7.12 and 7.24 contributions under the Environmental Planning and Assessment Act 1979 applicable to the development.

Date of public notification of the draft VPA

The draft VPA was on public notification from 26 June to 26 July 2019.

Land to which the VPA applies

The VPA applies to part of the Landmark Square Precinct (located at the eastern end of the Hurstville City Centre) at no.s 61-69, 71A, 73 and 75 Forest Road and 126 Durham, Hurstville. The legal description of the land is Lot 1 DP 225302, Lots 100 and 101 DP77625, Lots 1, 2, 3 and 4 DP12517 and Lot 10 DP621395 and any lot created by the subdivision of these lots.
