The Environmental Planning and Assessment (COVID-19 Development – Construction Work Days) Order 2020 was introduced to address an immediate need in response to the COVID-19 pandemic. This temporary measure ensured workers could practice social distancing without a loss of productivity or jobs and ensure homes and necessary infrastructure could be built.
 
The NSW Department of Planning, Infrastructure and Environment have advised that public health advice and rules have since changed and are less restrictive than they were at the height of the pandemic. Although COVID safe work plans are still required, there are no health orders currently in place that mandate social distancing on worksites.
 
The Minister has signed Environmental Planning and Assessment (COVID-19 Development—Construction Work Days) Order (No 1) 2021 which revokes the Construction Work Days Order.
 
The new Order will commence in 14 days (being 18 May 2021). Once the Order commences, construction work days and hours will return to those set out in a development consent, or hours permitted under the Codes SEPP (7am – 5pm, Monday to Saturday) for certain types of complying development. Construction will no longer be able to take place on Sunday or public holidays, unless specifically permitted in a development consent.
