Summary

A draft Voluntary Planning Agreement (VPA) has been prepared for 12-22 Woniora Road, Hurstville.

The draft VPA relates to the Development Application (DA2016/154) for an additional two stories comprising 14 additional units on top of Building D of the approved mixed use development on the Land.

The draft VPA relates to the carrying out of the Development of the Land and requires the Developer to make a monetary contribution to Council of $1,000,000 towards public infrastructure improvements within the Hurstville City Centre.
 

Background

The draft VPA relates to the Development Application (DA2016/154) for an additional two stories comprising 14 additional units on top of Building D of the approved mixed use development on the Land.

Council received an Offer to enter into a VPA in association with the Development Application DA2016/154 from Combined Projects (Hurstville) Pty Ltd on 30 August 2017.

The Offer to enter into the VPA was reported to the Council Meeting on 4 September 2017 (CCL211-17). Council accepted the terms of Offer to into a VPA. The draft VPA has been drafted in accordance with the Offer.

Existing VPA

There is an existing VPA executed on 16 June 2016 between the parties in relation to the Land and the development of the Land permitted under Development Application DA2015/191 approved on 10 May 2016. The existing VPA is available on Council’s website as an Executed Voluntary Planning Agreement.

 

Description of the Draft VPA:

The draft VPA requires the Developer to make a monetary contribution to Council of $1,000,000 towards public infrastructure improvements within the Hurstville City Centre.

The Planning Agreement excludes the application of section 94, section 94A and  s94EF contributions on the development consent.

The Offer to enter into the VPA was reported to the Council Meeting on 4 September 2017 (CCL211-17). Council accepted the terms of the Offer and the draft VPA has been drafted in accordance with the Offer.
